Goodie Tutors Terms and ConditionsEffective Date: April 2026Welcome to Goodie Tutors! Founded in 2016 by students, for students, Goodie Tutors operates an online platform that connects learners (Students or Parents/Guardians) with qualified, independent tutors (Tutors) for personalised academic support. These Terms and Conditions ("Terms”) govern your access to and use of the Goodie Tutors website, platform, and related services (collectively, the "Platform”). By accessing or using the Platform, creating an account, booking a session, or otherwise engaging with our services, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.1. Definitions

"Goodie Tutors” / "We” / "Us” / "Our”: Refers to the operators of the Platform (the company or entity behind Goodie Tutors).
"Student”: The individual receiving tutoring (may include minors; parents/guardians act on their behalf).
"Parent/Guardian”: The adult responsible for a minor Student.
"Tutor”: An independent contractor providing tutoring services through the Platform.
"Services”: The Platform’s facilitation of connections, booking tools, payment processing, and related support. We do not directly provide tutoring services.
"Session”: An individual online or in-person tutoring lesson arranged via the Platform.

2. Our Role and LimitationsGoodie Tutors acts solely as an intermediary marketplace. We:

Match Students with suitable Tutors based on subject, level, availability, and preferences.
Provide tools for scheduling, communication, and secure payments.
Vet Tutors to the best of our ability (qualifications, background checks where possible), but we do not guarantee Tutor performance, teaching quality, or specific academic outcomes.

Tutors are independent contractors, not employees or agents of Goodie Tutors. Any tutoring agreement is formed directly between the Student/Parent and the Tutor. We are not responsible for the content, quality, or outcome of any tutoring Session.3. Eligibility and Account Registration

You must be at least 18 years old or have parental/guardian consent to use the Platform.
If you are under 18, a parent or legal guardian must create and manage the account and accept these Terms on your behalf.
You agree to provide accurate, complete information during registration and keep it updated.
You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

4. Services and Booking

Sessions are typically conducted online (via Zoom, Google Meet, or similar tools agreed upon) unless otherwise arranged.
All bookings are subject to Tutor availability and confirmation.
You must provide accurate information about the Student’s grade level, subjects, goals, and any special needs.
Goodie Tutors does not guarantee that a suitable Tutor will always be available.

5. Payments and Fees

Students/Parents pay session or package fees as displayed on the Platform (inclusive or exclusive of VAT/GST as indicated).
Payments are processed securely through our payment provider. Goodie Tutors may charge a platform/service fee on top of the Tutor’s rate.
Tutors receive payment after Session completion (minus any platform fees), subject to our disbursement schedule.
Late payments may incur additional fees or interest.
All fees are non-refundable except as explicitly stated in our Refund Policy (linked separately).

6. Cancellations and Rescheduling

Cancellations or rescheduling must be made through the Platform at least 24 hours before the scheduled Session.
Late cancellations may result in full or partial charges (e.g., 50–100% of the fee, at Tutor/Platform discretion).
Tutors may cancel Sessions with reasonable notice; in such cases, we will assist with rescheduling or refunds where appropriate.
Repeated cancellations may lead to account restrictions.

7. Code of ConductUsers agree to:

Treat all parties with respect, professionalism, and courtesy.
Maintain confidentiality of any personal or academic information shared during Sessions.
Not engage in harassment, discrimination, or inappropriate behaviour.
Use the Platform only for legitimate tutoring purposes (not for completing assignments, exams, or academic dishonesty).
Comply with all applicable laws, including South African legislation on data protection (POPIA), consumer protection, and child safeguarding.

Violations may result in immediate account suspension or termination.8. Intellectual Property

All content on the Platform (logos, text, images, design) is owned by or licensed to Goodie Tutors and protected by copyright and trademark laws.
You may not copy, reproduce, modify, or distribute Platform content without prior written consent.
Tutors and Students retain rights to their own materials, but grant us a limited licence to use them for Platform operations (e.g., testimonials, with permission).

9. Disclaimers and Limitation of Liability

The Platform and Services are provided "as is” without warranties of any kind.
We do not guarantee continuous, uninterrupted, or error-free access.
We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform or any Tutoring Services.
Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
We are not responsible for disputes between Students/Parents and Tutors. Such disputes should be resolved directly between the parties.

10. IndemnificationYou agree to indemnify, defend, and hold harmless Goodie Tutors, its founders, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the Platform or Services.
Your violation of these Terms.
Any content you post or actions you take in connection with a Tutor or Student.

11. TerminationWe may terminate or suspend your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Platform.12. Changes to TermsWe may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the new Terms. We will notify users of material changes via email or Platform notice.13. Governing Law and Dispute ResolutionThese Terms are governed by the laws of the Republic of South Africa. Any disputes shall first attempt amicable resolution. Failing that, disputes will be subject to the exclusive jurisdiction of the South African courts.14.
